Whereas, unloading a railcar of grain at a licensed terminal elevator that has been fumigated, or may have been fumigated, poses a significant risk to the health and safety of employees of terminal elevators, and employees of the Canadian Grain Commission; and
Whereas, certain licensed terminal elevators require producer car shippers to provide a declaration that their producer cars have not been fumigated; now
Therefore, pursuant to sub-section 69(2) of the Canada Grain Act (the Act), effective immediately, operators of licensed terminal elevators may refuse delivery of any railcar of grain, including producer cars, that is not accompanied by a declaration from the shipper that the railcar has not been fumigated, notwithstanding the obligation contained in sub-section 69(1) of the Act that licensed terminal elevators receive all grain offered at the elevator, without discrimination.
