Order of the Canadian Grain Commission

Introduction:
- Section 44 of the Canada Grain Act (the “Act”) prohibits operation of elevators without a licence, unless the elevator is exempted by the Canadian Grain Commission (the “Commission”).
- The Commission has authority, under paragraph 117(b) of the Act, to make orders exempting a particular elevator from licencing requirements of the Act, and to fix such conditions on such an exemption.
- Monette Seeds Ltd. is seeking exemption from licensing by the Commission as a primary elevator.
- Monette Seeds Ltd. operates a primary elevator in Swift Current, SK.
- Monette Seeds Ltd. purchases grain solely from its parent company, Monette Farms Ltd. Therefore, all grain would be considered “shareholder grain.”
- This grain is then sold by Monette Seeds Ltd. to third-party buyers.
- In the circumstances, the Commission is of the opinion that the following order is necessary, given that all the grain is coming from the shareholder-owned farm, and the Commission is satisfied that Monette Seeds Ltd.’s operations do not require licensing for maintaining the quality, safekeeping and orderly and efficient handling of grain in Canada.
- The decision in respect of this order was made at a meeting of the Commission on June 10, 2026.
The Commission makes the following order:
- Monette Seeds Ltd. is exempted from licensing requirements under the Act for its primary elevator operations.
- This exemption is subject to the conditions that Monette Seeds Ltd. must:
- reapply for exemption annually, no less than 30 days before the start of each crop year, and provide information to the Commission
- continue to grant full access to its books and records to CGC auditors and inspectors.
- This exemption order is in effect until July 31, 2027, unless terminated earlier by further order of the Commission.
This order may be executed and delivered via facsimile or PDF and in any number of counterparts, each of which shall be deemed to be an original and all of which taken together shall be deemed to constitute one and the same instrument, and it shall not be necessary in making proof of this order to produce or account for more than one such counterpart.
